Diese AGB gelten für die Nutzung der iOS-App „Momly" (nachfolgend „App"), die von Nawras Nasser, Einzelunternehmer, Düsseldorfer Straße 26, 51379 Leverkusen (nachfolgend „Anbieter") entwickelt und über den Apple App Store vertrieben wird.
Der Vertrag über die Nutzung der App kommt mit dem Download aus dem Apple App Store zustande. Für kostenpflichtige Abonnements kommt der Vertrag durch Abschluss des Kaufs im Apple App Store zustande. Der Zahlungsvorgang wird vollständig über Apple abgewickelt.
Die App bietet ein monatliches Abonnement an. Die 7-tägige kostenlose Testphase ist automatisch im Abonnement enthalten. Nach Ablauf der Testphase verlängert sich das Abo automatisch, sofern es nicht mindestens 24 Stunden vor Ablauf des aktuellen Zeitraums über die Apple-ID-Einstellungen gekündigt wird.
Das gesetzliche Widerrufsrecht besteht gemäß § 356 Abs. 5 BGB nicht, da es sich um die Bereitstellung digitaler Inhalte handelt, sobald der Nutzer der Ausführung vor Ablauf der Widerrufsfrist zugestimmt hat. Die Kündigung des Abos erfolgt ausschließlich über die iOS-Einstellungen → Apple-ID → Abonnements.
Dem Nutzer wird das nicht-ausschließliche, nicht übertragbare Recht eingeräumt, die App für persönliche, nicht-kommerzielle Zwecke auf seinen Apple-Geräten zu verwenden.
Momly ersetzt keine ärztliche Beratung, Diagnose oder Behandlung. Die in der App bereitgestellten Inhalte (insbesondere WHO-Perzentile, Ratgeber-Tipps, Meilensteine) sind informativ und ersetzen nicht den Rat eines qualifizierten medizinischen Fachpersonals. Bei gesundheitlichen Fragen zu deinem Baby wende dich bitte an deinen Kinderarzt, deine Hebamme oder eine andere medizinische Fachkraft.
Der Anbieter haftet nur für Schäden, die auf Vorsatz oder grober Fahrlässigkeit beruhen. Die Haftung für leichte Fahrlässigkeit ist ausgeschlossen, soweit keine wesentlichen Vertragspflichten betroffen sind.

Änderungen dieser AGB werden dem Nutzer in der App angekündigt. Setzt der Nutzer die Nutzung der App nach Bekanntgabe fort, gelten die geänderten AGB als akzeptiert.
Es gilt deutsches Recht unter Ausschluss des UN-Kaufrechts. Gerichtsstand ist, soweit gesetzlich zulässig, der Sitz des Anbieters. Sollten einzelne Bestimmungen unwirksam sein, bleibt die Wirksamkeit der übrigen Bestimmungen unberührt.

These terms apply to the use of the iOS app "Momly" (the "App"), developed by Nawras Nasser, sole proprietor (Einzelunternehmer), Düsseldorfer Straße 26, 51379 Leverkusen (the "Provider") and distributed through the Apple App Store.
The contract for use of the App is concluded when the App is downloaded from the Apple App Store. For paid subscriptions, the contract is concluded through the purchase on the Apple App Store. Payment is handled entirely by Apple.
The App offers a monthly subscription. A 7-day free trial is automatically included. After the trial, the subscription renews automatically unless cancelled at least 24 hours before the end of the current period through your Apple ID settings.
The statutory right of withdrawal does not apply to the provision of digital content once you have consented to immediate execution. Cancellation of the subscription is handled exclusively through iOS Settings → Apple ID → Subscriptions.
The user is granted a non-exclusive, non-transferable right to use the App for personal, non-commercial purposes on their Apple devices.
Momly is not a substitute for medical advice, diagnosis, or treatment. Content provided in the App (in particular WHO percentiles, guidebook tips, milestones) is informational and does not replace the advice of qualified medical professionals. For health questions about your baby, please consult your pediatrician, midwife, or other qualified medical professional.
The Provider is liable only for damages caused by intent or gross negligence. Liability for slight negligence is excluded, except where material contractual obligations are concerned.
Processing of personal data is governed by our Privacy Policy.
Changes to these terms will be announced to users within the App. Continued use of the App after notification constitutes acceptance of the amended terms.
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction, as far as legally permitted, is the Provider's domicile. If individual provisions are invalid, the validity of the remaining provisions remains unaffected.
